On Wu Nai-ren’s outstanding debt to Taiwan Sugar Corporation

The Administrative Enforcement Agency of the Ministry of
Justice (AEA) provides the following explanation regarding the
amount owed to Taiwan Sugar Corporation (Taisugar) by former
Chairman Wu Nai-jen:
1. The main duties of branches under AEA are to handle matters
related to the enforcement of “monetary obligations under public
laws” (such as taxes, NHI premiums, and traffic fines, etc.) to
satisfy monetary claims of public laws; as for civil enforcement,
it is the compulsory enforcement procedure to realize the
creditor's “claims of private laws”, and the enforcement authority
would be the civil execution department of the district courts
affiliated to the Judicial Yuan. After investigation by the AEA,
there is currently no case involving the obligor Wu Nai-ren
that falls under the AEA branches.
2. According to news coverage, the amount owed by Wu Nai-ren to
Taisugar was a case of “civil damage” determined by the court,
which is not an administrative enforcement case. If Taisugar
wishes to petition for compulsory enforcement against him, it
shall do so in accordance with the Compulsory Enforcement Act.
Taisugar has also petitioned to the civil execution department of
the district court for compulsory enforcement.
3. AEA will list all the major debtors and supervise the affiliated
branches to handle cases as a group, strengthen horizontal
communication between agencies, and make good use of various
statutory compulsory sanctions (such as restricting the one's
residence, issuing injunctions, and applying to the court for arrest
and custody) to proceed the compulsory enforcement and strive to
collect the arrears.
